WAIVER OF LIABILITY – TENNIS & PICKLEBALL FACILITY

I acknowledge that I am at least 18 years of age and that I have carefully read (or had read to me), understand, and agree to the entire content of this Waiver of Liability. I hereby agree, on behalf of myself and any children under the age of 18 that I bring into the Tennis & Pickleball Facility (the “Minors”), to forever waive, release, discharge, indemnify and hold harmless SOF-XI Kauai PV Golf, LP, Princeville Makai Golf Club, Troon Golf, LLC, Hanalei School PTSA, Hanalei School Elementary and each of their respective owners, affiliates, directors, officers, agents, employees, representatives, successors and assigns, and any other parties acting on their behalf (collectively, the “Released Parties”) from any and all claims, liabilities, demands, actions, suits, rights, losses, damages, expenses and costs, including, but not limited to, attorneys’ fees and costs, and/or causes of action of whatever kind or nature, now or hereafter existing, whether known or unknown, present or future, foreseen or unforeseen, whether caused by the negligence of the Released Parties or otherwise, that may arise from my use of the Tennis & Pickleball Facility, including, without limitation, any damage or loss to property, bodily and/or personal injury, or death in connection therewith. I hereby, on behalf of myself and the Minors, waive any protections afforded by any statute or law in any jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which person giving the release does not know or suspect to exist at the time of executing the release. This means, in part, that I am hereby releasing Released Parties of any and all unknown future claims on behalf of myself and the Minors. If the Minors have another parent or legal guardian, I acknowledge that by clicking the box on the registration form I am also acting as the agent of the other parent or legal guardian and represent that I have the authority and agreement of the other parent or legal guardian to take the Minors into the Tennis & Pickleball Facility and to execute this waiver on their behalf and hold them legally bound by the foregoing terms, as if they clicked the box themselves.
